Pursuant to 23 United States Code (U.S.C.) 327 and the implementing Memorandum of Understanding (MOU) executed on December 14, 2016, the FDOT has assumed Federal Highway Administration's (FHWA's) responsibilities under NEPA for highway projects on the State Highway System (SHS) and Local Agency Program (LAP) projects off the SHS. In general, FDOT's assumption includes all highway projects in Florida whose source of federal funding comes from FHWA or which constitute a federal action through FHWA. This includes responsibilities for environmental review, interagency consultation and other activities pertaining to the review or approval of NEPA actions. Consistent with law and the MOU, FDOT will be the Lead Federal Agency for highway projects with approval authority resting in the Office of Environmental Management (OEM).
The process outlined in the Efficient Transportation Decision Making Manual is the FDOT's procedure consistent with the streamlining objectives of subsequent amendments to 23 U.S.C. sections 139 and 168 through the Moving Ahead for Progress in the 21st Century Act (MAP-21) and the Fixing America's Surface Transportation (FAST) Act and supports FDOT's Project Development and Environment (PD&E) Process. The 2017 version of the ETDM Manual incorporated requirements of the Memorandum of Understanding dated 12/14/2016 and executed by FHWA and FDOT concerning the State of Florida's participation in the Surface Transportation Project Delivery Program pursuant to 23 U.S.C. 327.In September 2019, the ETDM Manual was updated to reflect current practices, laws, and regulations. No major changes, substantive revisions, or additions (i.e. policy changes or new chapters) were made in this version. The ETDM Manual Revision Summary provides an overview of the edits made to the manual and coordination activities leading to the 2019 update. In July 2020, pen and ink changes were made to the ETDM Manual incorporating updates in the PD&E Manual, clarifying language for the issue resolution process, and correcting editorial errors. The 2020 revision summary describes these edits.
