The Claims Section processes claims against the Florida Department of Transportation (FDOT) by people seeking to recover money from FDOT for damage to their property or for bodily injuries. If you believe you have a claim against FDOT you may submit a claim to the Claims Section by completing a Statement of Claim for Property Damage or a Statement of Claim for Bodily Injury and Property Damage.
When either claim form is received with the required attachments the FDOT district office
in the area where the incident occurred will be notified. The district will
then investigate the claim. As soon as the Claims Section receives
and analyzes the results of that investigation a determination
will be made whether FDOT is
legally responsible and a
recommendation will be made to the
Department of Financial Services (DFS). The DFS, Division of Risk Management, makes the
final decision whether to pay claims against FDOT.
We ask for your patience as it requires some time to reach the point where FDOT has sufficient information to make a recommendation and for DFS and the Division of Risk Management to make a final decision.
FDOT uses two types of claims forms to process claims. The first form is a Statement of Claim for Property Damage which is used if you are claiming only property damage. The second form is a Statement of Claim for Bodily Injury and Property Damage which is used if you are claiming bodily injury only or claiming bodily injury and property damage. Both forms must be accompanied by a Lien Disclosure Statement.
The claim forms must be completely filled out and accompanied by supporting documentation in order to avoid delays in processing. Please include photographs, estimates, receipts, and copies of any other documents (e.g., police report or emergency report) that may exist. Once completed, the claim form must be signed.
Please return either the Statement of Claim for Property Damage or the Statement of Claim for Bodily Injury and Property Damage, the Lien Disclosure Statement, and other documentation to: Florida Department of Transportation, Claims Processing, 605 Suwannee Street, MS-58, Tallahassee, Florida 32399-0458, or you can email the documents to firstname.lastname@example.org. Upon receipt of the information requested your claim will be investigated in order to assess FDOT's liability, if any. Please allow 90 days for processing your claim. However, it may take up to six months to receive a final determination on your claim depending on the documentation provided.
